Title Transfers & Gifts

Adding or removing an owner, gifts between family members, and transfers after a separation or death.

Changing who is on title sounds administrative, and the registration itself is. The consequences are not. A transfer can trigger Property Transfer Tax, affect a mortgage, change what happens to the property on death, and, where the transfer follows a separation, unsettle terms both people thought were agreed.

We prepare transfers between family members, transfers that carry out a separation agreement, and survivorship applications after an owner dies, and we explain the consequences before anything is registered.

What we help with

  • Adding or removing an owner on title
  • Gifts of property between family members
  • Transfers required by a separation agreement or court order
  • Joint tenancy, tenancy in common and survivorship applications
  • Property Transfer Tax exemptions for related transfers
  • Trust and bare trust arrangements affecting title

How it usually works

  1. 01

    Understand the purpose

We start with why the transfer is happening, because tax, mortgage and estate consequences all follow from that.

  2. 02

    Check the title and mortgage

We search title and confirm whether the lender’s consent is needed before the transfer can register.

  3. 03

    Prepare, sign and register

We prepare the transfer and any tax return, meet you to sign, register the change and report to you afterwards.

Questions

Common questions about title transfers & gifts

Is a transfer to a family member tax free?

Not automatically. Some related transfers qualify for a Property Transfer Tax exemption, and there can be income tax consequences even when no money changes hands. Get advice before signing anything.

Should we hold title as joint tenants or tenants in common?

Joint tenancy usually means the survivor takes the whole property automatically; tenancy in common means each share passes under that owner’s will. The right choice depends on your family and your estate plans.
