Serving Delta
Wills and powers of attorney for Delta clients
We prepare wills, powers of attorney and representation agreements for Delta clients at our office on the Surrey–North Delta border, minutes from Sunshine Hills and Scottsdale.
Delta families often have something on the other side of a border: a property in Washington State, an account left behind in another country, or children who have settled abroad and would have to administer the estate from there. Assets outside British Columbia do not always follow a BC will, and an executor living outside the province can be required to post security.
How we help Delta clients
- WillsDeciding who inherits, who administers your estate, and who cares for your children.
- Powers of AttorneyNaming someone you trust to handle your finances and property if you cannot.
- Representation AgreementsNaming who speaks for your health care and personal care if you cannot speak for yourself.
Courts that hear Delta matters
- Depending on the type of matter, Delta files are generally heard at Surrey Provincial Court or the New Westminster Law Courts.
- Civil Resolution Tribunal (online): small claims up to $5,000 and most strata disputes.
Questions from Delta clients
I own a place in Washington State. Does my BC will deal with it?
Land is governed by the law of the place where it sits, so a property in Washington is dealt with under Washington law whatever your BC will says about it. In practice that usually means advice in both places, and sometimes a separate document for the American property. Tell us about it at the first meeting rather than after the will is drafted.
How often should a will be reviewed?
Every few years, and straight away after a marriage, separation, birth, death, a significant purchase or sale, or a move to or from another province or country.
Where should the original will be kept?
Somewhere safe, accessible and known to the executor. The location can also be filed with the BC wills registry, so that a search after death finds it.
Can these documents be prepared in one meeting?
Usually the set is prepared over two: one to take instructions and one to sign. Where something is urgent, such as surgery scheduled for the week ahead, tell us and we will work to it.
